Alabama's DUI Law
In 1995, the state of Alabama passed a new DUI law. Listed below are some
of the highlights of the law.

A person cannot drive or be in actual physical control of any motor vehicle
while there is a 0.08 percent or more by weight of alcohol in his or her
blood.

Upon a first conviction for DUI, a person shall be punished by paying a fine
of not less than $500.00 nor more than $2,000.00 and his or her driver's
license will be suspended for 90 days.

Upon a second conviction for DUI within a 5 year period, a person shall be
punished by a fine of not less than $1,000.00 nor more than $5,000.00 and
may be imprisoned for a period of up to 1 year. It is mandatory that he or
she sever a minimum of 48 consecutive hours in jail or performing community
service for not less than 20 days and his or her driver's license will be
revoked for a period of 1 year.

Upon a third conviction for DUI within a 5 year period, a person shall be
punished by a fine of not less than $2,000.00 nor more than $10,000.00,
imprisonment for not less than 60 days and his or her driver's license will
be revoked for a period of 3 years.

Upon a fourth or subsequent conviction for DUI within a 5 year period, a
person shall be punished by a fine of not less than $4,000.00 nor more than
$10,000.00 and imprisonment for not less than 1 year and 1 day nor more than
10 years. A fourth or subsequent conviction will be considered a Class C
felony and a person's driver's license will be revoked for a period of 5
years.
