IMMIGRANT
VISA AND PERMANENT RESIDENT STATUS FOR YOUR INTERNATIONAL SPOUSE
![]()
If
you are a United States citizen married to an international spouse and
if your international spouse is already in the United States in some nonimmigrant
status, you may be able to file an immediate relative petition, and your
spouse may be able to apply for permanent resident status with your local
USCIS office which has jurisdiction over your place of residence. I can
help prepare your and your spouse's paperwork for submission with your
local USCIS office and follow up with your USCIS office if necessary. Click
here to obtain a questionnaire and more details about the services I would
provide in your case.

If
you are a United States citizen married to an international spouse who
is currently outside the United States, you may petition for an immigrant
visa on your spouses behalf. Once your petition is approved by the USCIS,
your international spouse will be interviewed at a U.S. Consulate abroad,
and if approved would enter the United States with permanent resident or
conditional permanent resident status. There is also now the option of
submitting an additional petition for a K-3/K-4 visa(s) for you spouse
and minor children located abroad. Call me to discuss your case if you
are interested in hiring me to help prepare and file your petition, and
to follow up with the USCIS and the U.S. Consulate if necessary about your
case - (916) 443-2664.
Some U.S. Consulates will
allow the United States citizen spouse to file the paperwork directly with
the Consulate. The advantage is that this is usually a much faster process
than filing your paperwork with the USCIS Service Center which has jurisdiction
over your place of residence; however not all U.S. Consulates will allow
you to file your paperwork directly with the Consulate. Call me to discuss
your case if you are interested in hiring me to help prepare and file your
petition, and to follow up with the U.S. Consulate if necessary about your
case (916) 443-2664.

If
you are a lawful permanent resident and your spouse is outside the U.S.
you may submit an immediate relative petition for your spouse, however
there will likely be a lengthy waiting period for your priority date to
become current. If your spouse is already in the United States, you should
contact an immigration attorney immediately to have you spouse's case evaluated.
I can perform this consultation service for you and evaluate your options.

Your
success with any of these procedures will depend upon you and your international
spouse meeting the eligibility requirements. Whether you and your spouse
are eligible for an immigration benefit will be determined by the USCIS
(and the U.S. Consulate when your spouse must process through a U.S. Consulate
abroad).
