Life Care Planning

Arriving at a fair and just settlement, trust amount, plus the actual litigation of injury is a very difficult part of each case. No matter if it is a “big dollar” catastrophic injury file, medical mal-practice, personal injury, workers’ compensation, or product liability file, you still want to be able to support and defend the monies that are necessary to obtain a comfortable lifestyle throughout that person’s life span. How is this accomplished?

A Life Care Plan is a comprehensive, multidisciplinary approach to a cost analysis, which systematically documents the needs of the injured client and projects the costs of the needed supplies and services for an injured person’s life span. The plan communicates this information (in today’s dollars) clearly to all who might be involved (such as physicians, allied healthcare providers, attorneys, judges and juries). It supports these needs for setting reserves, trusts, and settlements. All plans are prepared in anticipation of court reviews and I am prepared to defend each plan in the courtroom arena as an expert witness.

Choosing a Life Care Planner

How do you choose the right life care planner for the right file? This is one of the more important aspects of finding the “right fit” for your case. The life care planner should be a person, who has active catastrophic case management experience in the appropriate injury of the file, a certification in life care planning and experience in doing life care plans. There are many “life care planners” trying to do these plans without having the appropriate credentials. It is not a “learn by the seat of your pants” type of specialization. There are several mail-order firms, which only gives very rudimentary information. These should be avoided. The Life Care Planner needs to have education, experience and certification. Presently, there are two certification boards offering either the CLCP or CNLCP. Many of the professional life care planners are active in their national organizations, are versed in the Standards of Care for Life Care Planners and take part in seminars to further their skills.
