Self regulation in the adjudication of complaints has failed. Ordinary consumers need protection from dishonest and incompetent practioners of the legal services.
In 1995 some of those dissatisfied with the complaints system founded CASIA
BEWARE! It appears that
Solicitors can make an ex-client or others bankrupt over a bill
of a mere £750 following an initial summary judgment. This may
not be the right expression but apparently " Surplus
bankruptcies", i.e. bankruptcies in which someone's asset s
vastly exceed their debt, and which are supposed to be
exceedingly rare, are on the increase. CASIA has a
disproportionate number of cases compared to the size of the
membership. Where an ex-client or another has objected to the
amount and non-itemised nature of a bill, this procedure seems to
be increasingly used as a first, not a last, resort.
Once anyone is made bankrupt and a trustee appointed, that trustee immediately becomes the owner of their home and assets so the bankrupt has no means of paying off the debt even if he/she is still challenging it and even if they want to pay. Everything is forfeit.
