UIFSA
(as explained by Attorney Sherry Schmidt Ellison)
UIFSA is the law that will be replacing URESA. The federal government has required that all states pass UIFSA. Georgia was one of the last to do so.
What this law does is makes interstate enforcement much easier, and in theory, faster. Before, only CSE agencies could use URESA. UIFSA will govern all cases. It is a huge statute, just as URESA was. Each state is required to pass the legislation almost 100% as drafted, so the law should be much more uniform than URESA was. UIFSA's main principle is that if there is already an order entered, you do NOT enter new orders each time the defendant moves to a different state.
URESA did, and that resulted in several conflicting orders in different states. So, UIFSA says if there is an order, it's the one that has to be used no matter where the defendant goes.
OK, what if there are more than one order already out there. UIFSA provides a flow chart type mechanism to figure out which one is the proper order to enforce. Meg Haynes - one of the drafters of the legislation - told me that they had to come up with some means and they picked one. It's not great, but it made the most sense. If there is an order in the state where the custodial parent and child are, that is the order to be enforced.
This means that if a mom and her kids are in Alaska and they got a divorce there and were awarded $15.00 per week support, and then the dad moved to Colorado, and a URESA was done which established an order in Colorado for $800.00 per month, then guess what? The $15.00 per week is the order which is proper to be enforced.
There's a lot of scenerios and it's hard to write out exactly what it does, but it's out there. This is an area that I'm especially familiar with because my judicial circuit - being near Atlanta - had a substantial number of interstate cases.
