Purpose and Effect These paragraphs show how you may use the BEEmar Music website. Please read them carefully. By using the Job Channel you are indicating your acceptance to be bound by these terms, otherwise, the right to use the site will be revoked. We reserve the right to amend, update, add to or remove any or all sections on this or any other page on the site. Continued usage indicates your continued acceptance of the site at that time, therefore, it would be in your best interests to read this page periodically.
Use of Material You may make a copy of any material shown on the BEEmar Music website, as long as it is regarding a genuine transaction between yourself and us. (See Copyright and Intellectual Property Rights below.)
Copyright and Intellectual Property Rights The contents of the BEEmar Music website, e.g. text, graphics, images and logos, are protected under UK law. All contents and their arrangement on the site are our property. Unauthorised use of the contents may violate copyright, trademark and other law. You must not remove any copyright or trademark or other proprietary notices in the contents and must not sell, modify, use or reproduce the contents for any public or commercial purpose or on any other website in a networked computer environment.
Specific Prohibited Uses You may not use the BEEmar Music site to transmit, distribute, store or destroy any material in violation of any applicable law or regulation. Any transactions that infringe the intellectual property rights or violate the privacy and personal rights of any person will be deemed sufficient to revoke access. You are responsible for maintaining the confidentiality of your personal data supplied to us in connection with your dealings with us and you agree to notify us immediately by e-mail of any changes which may affect these dealings (e.g. home or e-mail address etc.).
You are responsible for your own communications and for the consequences of sending them. This means that, once an order has been placed, it will be considered a formal contract requiring us to supply the goods described, in a timely fashion, once subsequent payment has been made, in advance. Goods will be shipped out by us, in sufficient packaging, within five working days of any cheques being cashed. It will not be possible to cancel an order or to return funds supplied by you once any cheque has cleared. Otherwise, any order may be cancelled, either by telephone (providing proof of identity and the actual order details are supplied) or e-mail. If there is a problem with the items when they are received (and there is justifiable cause for complaint), return the goods to us and your money (along with any postage costs) will be refunded.
By sending an order or inquiry to us, you permit us to use, copy, adapt and use in any way any rights that may exist in such communication and promise us that if such rights are owned by a person other than you, that person has permitted you to use them and allow us to do so as set out above.
Our Service to You The BEEmar Music website aims to provide quality products at reasonable prices. We will add and/or delete items from time to time - if required, you may be notified of changes by e-mail. We may also e-mail you occasionally regarding items similar to the ones you have bought in the past if and when they come up for sale. We will not, however, enter into any bargaining or "haggling".
Our Liability and Disclaimer Any items listed as for sale or auction on the BEEmar Music website are put there in good faith with the intent to sell. They will be accurately described - the condition they are in being rated as per industry standard. Items on the site will be removed once they have been sold.
We do not guarantee that this site will always operate error free or that it or its server are free from computer viruses or harmful mechanisms. However, we will endeavour to maintain the site and keep it as error- and virus-free as possible. Please notify us by e-mail if there are any errors or inconsistencies and we will address them with haste.
These promises are the sole extent of our liability to you and replace all guarantees, conditions, undertakings and obligations implied by statute, common law, custom, trade usage, course of dealing or otherwise, all of which are hereby excluded to the fullest extent permitted by law. This does not affect your statutory rights.
Termination We reserve the right to do anything required to terminate your access to BEEmar Music if we reasonably believe that you are in breach of these Terms of Use.
General We make no claims that the BEEmar Music website may be lawfully viewed, used or downloaded outside the UK.
You may not (but we may) assign, sub-license or sub-contract any rights and obligations under these Terms of Use.
These Trading Terms shall be governed by and construed in accordance with the Laws of England.
Notwithstanding that the whole or any part of any provision of these Terms of Use may prove to be illegal or unenforceable, all other provisions and the remainder of the provision in question shall remain in full force and effect.
These terms and any contract made between us in relation to your use of Job Channel shall not confer any benefit or right of action on any third party and the provisions of the Contract (Rights of Third Parties) Act 1998 are hereby excluded to the fullest extent permissible by law.
